Pennsylvania Labor & Employment Attorney

Employment law covers the relationships between employers and their employees, as well as their potential and former employees. Both federal and state laws control various aspects of the employer/employee relationship, and each side's rights and obligations. Because of the complexity of the employment relationship, this area of law involves issues as diverse as discrimination claims and record-keeping, taxation and workplace safety.

In the United States, relationships between employers and employees can either be through a contract or at-will. Pennsylvania is an at-will employment state. At-will employment means that the relationship between an employer and an employee can be ended at any time. A worker can end his or her employment voluntarily by resigning, or an employer can terminate an employee. An employer is allowed to terminate an employee based on the quality of the employee's work or the nature of his or her personality. At the same time, there are laws that protect an employee from being wrongfully terminated, sexually harassed or discriminated against.

The Pennsylvania Human Relations Act combines federal laws to ensure that an employer does not discriminate against employees. Title VII of the Civil Rights Act of 1964, protects employees from discrimination on the basis of race, gender, religion or national origin. The Age Discrimination in Employment Act (ADEA)Americans with Disabilities Act (ADA) bars discrimination of disabled individuals. In addition, employers cannot retaliate against employees who file discrimination claims with the Equal Employment Opportunity Commission (EEOC).

If you feel you have been wrongfully terminated, sexually harassed on the job or that your employer is retaliating against you for asserting your rights, you need a Pennsylvania Employment Law Attorney or a Pennsylvania Labor Lawyer, who understands the complex nature of the laws and knows how to approach courts that can be hostile to the rights of individuals.
